Purchases made on www.inpelleitalia.it are regulated by these general conditions for sales, which can be modified at any time by Nuova Pugliatex S.r.l., with effect from their publication on the site. The sending of the customer’s order is valid as acceptance of the sales conditions published at the time on the site.
Nuova Pugliatex S.r.l. complies with regulations governing distance contracts according to art. 50 and following the Legislative Decree n. 206 of 6 September 2005, as well as that relating to electronic commerce according to Legislative Decree no. 70 of 9 April 2003. These general conditions must be considered an integral and substantial part of the contract.

Nuova Pugliatex S.r.l. invites the Customer to carefully read the conditions below, to print them and / or to save them.

1) Glossary

1.1 “Online sales contract” means the sales agreement relating to tangible material goods marketed by Nuova Pugliatex Srl, stipulated between the latter and the consumer, as part of a distance selling system through telematic tools, organized by Nuova Pugliatex S.r.l.

1.2 “Customer” means the physical person making the purchase referred to in this contract, for purposes not related to his commercial or professional activity.

2) Subject of the contract

2.1 In virtue of this contract, respectively, Nuova Pugliatex S.r.l. sells and the Customer buys remotely, via telematic tools, tangible material goods indicated and offered for sale on the website www.inpelleitalia.it

2.2 The products referred to in the previous point are illustrated on the website www.inpelleitalia.it and described in the relative information sheets; the product image may not be perfectly representative of its characteristics and may differ in color, size and accessories.

2.3 These general conditions of sale do not regulate the supply of services or the sale of products made by third parties who use direct links to the site www.inpelleitalia.it through banners or other hypertext links / links. In no case Nuova Pugliatex S.r.l. can it be held responsible for the supply of services promised by third parties or for the execution of electronic commerce trading between Nuova Pugliatex S.r.l. and third parties.

2.4 Nuova Pugliatex S.r.l. reserves the right not to process orders from users that are not “Customers” and any other order not in conformity with the commercial policy of Nuova Pugliatex S.r.l.

3) Stipulation and conclusion of the contract

3.1 The contract between Nuova Pugliatex S.r.l. and the Customer is concluded through the online procedure by accessing www.inpelleitalia.it, after the formalization of the purchase proposal of the products referred to in points 2.1 and 2.2 of the previous article.

3.2 The purchase contract is concluded by completing the following procedure, available in Italian only, which can always be corrected, modified and canceled, until the order is sent:

• by accessing the website www.inpelleitalia.it the Customer, after registering, must add the selected products to the shopping basket, complete all the following pages, following the instructions, and transmit electronically the page with his personal data and the purchase order to Nuova Pugliatex S.r.l.;
• the order page contains a link to these general conditions of sale and also contains information on the main characteristics of each product ordered including price (VAT included), type of payment, delivery terms and general terms and conditions for the return of the products;
• before proceeding with the sending of the order, the Customer will be asked to identify and correct any possible errors occurred during filling in the fields and carefully read the general terms and conditions governing the sale and purchase, to print a copy and save or request a copy for personal use;
• an order will be deemed sent when Nuova Pugliatex S.r.l. will receive the order proposal electronically and after verification of all the information.

3.3 The order sent by the customer will be binding for Nuova Pugliatex S.r.l. only if the entire order procedure has been completed regularly and correctly, without any highlighting of error messages from the website, and after an order confirmation sent by Nuova Pugliatex S.r.l.. The e-mail contains the details of the customer and the order, a summary of the general and particular contract conditions, the price of the purchased goods, the chosen means of payment, the transport costs, taxes, the indication of the right of withdrawal and the delivery address. The Customer undertakes to verify the correctness of the data and promptly communicate any corrections to Nuova Pugliatex S.r.l.

3.4 Effettuando un ordine il Cliente dichiara di aver preso visione di tutte le indicazioni a lui fornite durante la procedura d’acquisto, e di accettare integralmente le presenti condizioni generali di vendita. The contract is not considered concluded and effective between the parties if in default of what is indicated in the previous point.

3.6 Nuova Pugliatex S.r.l. may not take charge and process the order if there are not sufficient guarantees of solvency of the payment, if the orders are incomplete or incorrect, or if the products are no longer available. In the above cases, the Customer will be informed by e-mail that the contract will not be executed by Nuova Pugliatex S.r.l. specifying the reasons.

3.7 The contract stipulated between Nuova Pugliatex S.r.l. and the Customer must be considered concluded with the acceptance, even partial, of the order by Nuova Pugliatex S.r.l. This is considered tacit acceptance, unless otherwise communicated to the Customer.

3.8 Pursuant to art. 12 of Legislative Decree 70 of 2003, Nuova Pugliatex S.r.l. informs the Customer that every order sent is stored in digital or paper form at its headquarters, according to criteria of confidentiality and security. The customer can at any time request a copy from Nuova Pugliatex S.r.l.

4) Payment

4.1 4.1 Every payment can only be made by one of the methods indicated on the website www.inpelleitalia.it. All major national and international credit cards are accepted:

• PAYPAL (Postepay, Visa, Maestro, MasterCard, American Express, Discover, Aura)

4.2 For payments made by PayPal, the amount will be charged only when the order is complete and ready for delivery. If the product is not available after registering the order, Nuova Pugliatex S.r.l. will take the necessary measures to reverse the transaction relating to unavailable goods.

4.3 All the orders, before being processed, are subjected to appropriate checks directly by the relative credit card issuers, to protect the customer. If, for any reason, it is not possible to debit the amount due, the sales process will be automatically cancelled and the sale will be terminated pursuant to art. 1456 of the Italian Civil Code. The customer will be informed by e-mail.

4.4 The communications relating to the payment and the data communicated by the Customer take place on special protected lines and with all the guarantees ensured by the use of security protocols provided for by the payment circuits.

5) Prices

5.1 I prezzi di vendita esposti sul sito www.inpelleitalia.it sono da intendersi comprensivi di I.V.A. e sono riferibili unicamente ai prodotti venduti on-line. Il prezzo applicato sarà quello vigente al momento dell’ordine ed indicato nell’e-mail di conferma dell’ordine, senza considerare aumenti o diminuzioni di prezzo, anche per promozioni, eventualmente intervenuti successivamente.

5.2 The shipping costs, charged to the customer for orders of less than € 45, are not included in the purchase price, but are indicated and calculated at the time of the conclusion of the purchase process before payment.

5.3 The issue of the invoice is not obligatory, if it is not requested by the Customer no later than the time of carrying out the operation, as indicated in art. 22 of the Presidential Decree of 26/10/1972 n. 633. By sending the order to Nuova Pugliatex S.r.l. the Customer agrees to receive the invoice / receipt in electronic format. The customer can receive the invoice / receipt in paper form upon request to Nuova Pugliatex S.r.l. After the invoice has been issued, it will not be possible to make any changes to the data indicated in the same.

6) Product availability

6.1 The products are available during the time when the customer consults the product data sheets; however the availability must be considered purely indicative because, due to the simultaneous presence on the site of multiple users, the products could be sold to others before confirming the order. Therefore, no responsibilities may be attributed to Nuova Pugliatex S.r.l. in case of unavailability of one or more products.

6.2 Nuova Pugliatex S.r.l. will not be in any way responsible for the temporary or definitive unavailability of one or more products. The site highlights the cases of purchase restrictions. In case of unavailability, even temporary, of the products requested, Nuova Pugliatex S.r.l. undertakes not to charge the customer the corresponding price. If the order has been sent and the price has already been paid for items no longer available, Nuova Pugliatex S.r.l. will refund the Customer of the full amount paid for those items.

6.3 Even after the submission of the order confirmation by Nuova Pugliatex S.r.l., there might be cases of partial or total unavailability of the goods. In this eventuality, the Customer will be promptly informed by e-mail and will be able to decide whether to accept a partial delivery, obtaining a refund for the unavailable products or whether to request the cancellation of the total order, with consequent refund of the amount already paid, communicating it to Nuova Pugliatex S.r.l.

6.4 For the eventuality referred to in the previous point, the Customer can choose, when sending the order, whether to accept a different supply of the same value.

7) Delivery

7.1 Nuova Pugliatex S.r.l. will deliver the products selected and purchased by express courier to the address indicated by the Customer in the order, as confirmed in the summary email referred to in point 3.3

7.2 Orders will be processed as soon as received. Nuova Pugliatex S.r.l. undertakes to deliver the products as quickly as possible, within 30 days from the contract date.

7.3 The total amount of delivery costs will be visible before proceeding with the purchase confirmation.

7.4 The goods will be checked and delivered to the forwarder intact and without defects. Nuova Pugliatex S.r.l. shall not be responsible for any delays or damage attributable to the carrier.

7.5 The goods ordered depend exclusively on the will of the customer. If they are refused, Nuova Pugliatex S.r.l. will charge the customer for the return transport costs.

8) Responsibility

8.1 Nuova Pugliatex S.r.l. shall not be held responsible for inefficiencies resulting from accident or force majeure or unforeseeable circumstances, even if depending on Internet malfunctions and disservices.

8.2 Furthermore Nuova Pugliatex S.r.l. shall not be responsible for damages, losses and costs incurred by the Customer following the non-execution of the contract for reasons beyond its control, unless they are the result of fact or omission of Nuova Pugliatex Srl, being the Customer only entitled to a full refund of the purchase price and any accessory costs incurred.

8.3 Nuova Pugliatex S.r.l. shall not be held responsible for the information, data and any technical or other inaccuracies which may be found on the site, if they have been communicated by third parties and have been verified by Nuova Pugliatex S.r.l. in accordance with the due diligence.

8.4 Nuova Pugliatex S.r.l. shall not assume any responsibility for fraudulent and illegal use by third parties of credit cards, cheques and other means of payment, upon payment of the products purchased, provided it proves the implementation of all possible precautions adopted on the basis of the best known skill, experience and due diligence.

9) Right of withdrawal

9.1 The Customer has the right to withdraw without any penalty and without specifying the reason, within fourteen days from the day on which the Customer or a third party, other than the carrier and designated by the Customer, acquires physical possession of the goods. In the case of a contract relating to multiple goods ordered by the Customer in a single order and delivered separately, the period starts from the day on which the Customer or a third party, other than the carrier and designated by the Customer, acquires physical possession of the last good.

9.2 9.2 For the exercise of the right of withdrawal, the Customer shall inform Nuova Pugliatex S.r.l., VIA REPUBBLICA 46 – 70015 NOCI (BA), e-mail info@inpelleitalia.it, tel. +39 080 497 72 74 of its decision by a clear statement (e.g. letter sent by post, fax or e-mail). For this purpose, he can use the withdrawal standard form provided in the Annex I part B to D.Lgs. 21-2-2014 n. 21, with the following content:

– Client’s signature (only if the form is notified in paper version)
– Date

9.3 To meet the withdrawal deadline, it is sufficient for the Customer to send the communication concerning the exercise of the right of withdrawal before the deadline of the withdrawal period.

9.4 If the Customer withdraws from this contract, all payments made to Nuova Pugliatex Srl will be refunded, including delivery costs (with the exception of the additional costs resulting from the choice of a type of delivery other than the least expensive type of standard delivery offered by Nuova Pugliatex S.r.l.), without undue delay and no later than fourteen days starting from the day Nuova Pugliatex Srl was informed about the decision to withdraw from this contract. Refunds will be made in the same form of payment as the original purchase, unless expressly agreed otherwise; in any case, it will not incur in any additional cost as a result of such refund. Nuova Pugliatex S.r.l. reserves the right to withhold the refund until it has received the goods back or the Customer has supplied evidence of having sent the goods back, whichever is the earliest.

9.5 In case of exercise of the right of withdrawal, the Customer returns the goods or delivers them to Nuova Pugliatex S.r.l., VIA REPUBBLICA 46 – 70015 NOCI (BA), without undue delay and in any case within fourteen days from the date on which he informed Nuova Pugliatex S.r.l. about his decision to withdraw from the contract. The Customer shall be charged for the direct cost of returning the goods.

9.6 The Customer is responsible for any diminished value of the goods that results from handling the goods in a way other than what is necessary.

9.7 If the right of withdrawal is exercised, Nuova Pugliatex S.r.l. will not be responsible for the transport costs for the return or for any loss or damage to the products due to third parties.

10) Guarantees and assistance

10.1 Nuova Pugliatex S.r.l. sells high quality products. In any case, a legal guarantee of conformity for goods exists as a form of Customer protection. In case of products’ receipt not complying with the sale contract, pursuant to art. 129 et seq. of the Consumer Code, the Customer loses all rights if he does not report the lack of conformity to the seller within two months from the date on which the defect was discovered. The complaint is not necessary if the seller has recognized the existence of the defect or has concealed it.

10.2 In any case, unless proven otherwise, it is assumed that the lack of conformity that occurs within six months of delivery of the goods already existed on that date, unless this hypothesis is incompatible with the nature of the good or with the nature of the lack of conformity.

10.3 In case of a lack of conformity, the Customer may request, alternatively and without charge, under the conditions indicated below, the repair or replacement of the purchased good, a reduction of the purchase price or the termination of the contract, unless the request is not objectively impossible to satisfy or excessively expensive for Nuova Pugliatex Srl pursuant to art. 130, paragraph 4, of the Consumer Code.

10.4 The request must be written and sent by registered mail, to Nuova Pugliatex S.r.l. VIA REPUBBLICA 46 – 70015 NOCI (BA) indicating the willingness to process the request, or the reasons that prevent from doing it, within seven working days from the reception. In the same communication, if the Customer request has been accepted, Nuova Pugliatex S.r.l. must indicate the shipping methods or return of the goods as well as the deadline for returning or replacing the defective goods.

10.5 If repair and replacement are impossible or excessively expensive, or Nuova Pugliatex S.r.l. has not repaired or replaced the goods within the deadline referred to in the previous point or, finally, the replacement or repair previously carried out has caused significant inconvenience to the Customer, the latter may request, of his choice, a reasonable price reduction or the termination of the contract. In this case, the Customer shall send his request to Nuova Pugliatex S.r.l., which shall indicate its willingness to act on it, or the reasons that prevent it from doing so, within seven working days from receipt.

10.6 In the same communication, if the customer request has been accepted, Nuova Pugliatex S.r.l. shall indicate its proposal of price reduction or the method for returning the defective goods. In such cases the Customer shall indicate the methods for re-crediting the amounts previously paid to Nuova Pugliatex S.r.l.

10.7 The Customer undertakes to pay the price of the purchased good in the terms indicated in these General Conditions of Sale.

10.8 The Customer undertakes, once the online purchase procedure has been completed, to print and keep these Terms and Conditions of Sale, which will have already been expressly accepted before the conclusion of the procedure.

10.9 The Customer is the sole responsible for the correctness of the data entered in the registration procedure and undertakes not to enter false and / or invented data. Nuova Pugliatex S.r.l. shall not be liable for the issue of tax records due to incorrect data provided by the Customer.

11) Privacy

INFORMATION IN ACCORDANCE WITH D. LGS. 196/2003

We inform you that, pursuant to art. 13 of Legislative Decree 196/2003, Nuova Pugliatex S.r.l. will process the data you provide in accordance with the legislation on the protection of personal data.
The provision of data is necessary and therefore any refusal to provide them makes it impossible to process the online purchase service.
We also inform you that the personal data provided are electronically collected and processed, directly and / or through delegated third parties (home delivery, mailing and data entry companies) and may be used, previous your necessary and explicit consent, for the purposes listed below:

• execution of the service and management of the purchase order;
• statistical processing, sending of advertising material, even by e-mail.

12.1 These General Conditions of Sale contain all the sale clauses.

12.2 If one or more provisions of these General Conditions of Sale are considered invalid or incompatible pursuant to the law or following a decision by a jurisdiction body, the other provisions will continue to have full force and efficacy.

 

13)13) Applicable law. Choice of the Forum

13.1 All contract relationships between the parties and these general contract conditions are governed by Italian law.

13.2 Any dispute related to the application, interpretation and execution of these general conditions of sale, will fall within the competencies of the judge of the place of residence or domicile of the consumer.

14) Final clause

14.1 This contract repeals and replaces any agreement or negotiation, written or oral, previously made between the parties and concerning the subject of this contract.
